Medical Marijuana’s Great (And Odd) Midwest Test: Iowa

    Iowa, America’s breadbasket, home to liberal scion Tom Harkin and conservative contrarian Charles Grassley, is vetting the issue of medical marijuana politically like no other previous state has by conducting a series of public testimonies, convened by the Iowa Pharmacy Board (who was ordered by a Polk County judge to do so in April in response to lawsuits brought by medical marijuana patients in Iowa against the IPB).

    Two of the first four public hearings have already happened (August 19 in Des Moines and Sept. 2 in Mason City); the next hearings are:

    October 7 in Iowa City and November 4, Council Bluffs

    At the Mason City hearing on September 2, eight speakers, all but one in favor of medical marijuana law reforms, spoke out against the prohibition of medical marijuana in Iowa.

    Des Moines resident and multiple sclerosis patient Ray Lakers, 42, who was jailed for possessing less than a gram of medical marijuana in 2005, spoke of medical marijuana’s utility and benefit to his life. Conversely, Maedene Sappenfield of Mason City spoke out against it in the Globe Gazette, “I have a son-in-law in North Carolina who has MS and he functions without marijuana very well, so it is possible.”

    The IPB does not have the authority to legalize marijuana for medical use, but it could suggest to lawmakers to move marijuana to a schedule lower than I. In turn, Iowa lawmakers would have to pass amending legislation. An AP article indicates an interesting legislative challenge (some would say ‘poison pill’): “the [IPB] said that the drug [marijuana] would have to be used as treatment in all states for Iowa to reclassify it.”

      The notion that government is out for the good of the populus is a falicy. The government is a man eating machine that is blind to the needs of the people. It’s only goal is control and survival at any cost… “Justice is blind” >>> is now more true then ever. T. Jefferson is probably rolling over in his grave.

      Individuals are routinely selected and persecuted for speaking out on subjects the government wants suppressed. The Patriot Act gave them unbridled free licence to wire tap and build files on Americans, with very little actually done towards foreign enemies. I know this is off the track, but I applaud you for collaterally attacking them… this is what they fear the most… especially when they are patently wrong and know it…

      It is time that Iowa is known for rational and open mindedness rather than hicks in the sticks wearing bib overhauls. Believe me in other parts of the US and the world, that is the perception.

      I know better, that’s why I have lived here 56 years, travelled all over and see what the people of Iowa have to give. Maybe the hard liners have or are being attritioned out of existence >>> or let’s at least hope soon. They are the problem … not the solution.

      I don’t know a catchy phrase for good luck in a legal setting… So break a leg. Good luck in court..

      We are exposing their corruption. The Iowa Board of Pharmacy has a duty to review the drug law annually and make recommendations for changes to the Iowa Legislature. The Board of Pharmacy has just sat on its hands while 13 states have enacted medical marijuana laws and haven’t even suggested reviewing marijuana’s classification in Iowa. That is a total breach of duty owing to the citizens of Iowa. They have been exposed and today they will be further exposed as a front for the big pharmaceutical companies to put profits ahead of the health and welfare of the Iowa citizens.

      Good morning Carl…

      Hope all is well at ground zero. Been kinda quite on the home front since the Iowa Board of Pharmacy lacks any crediability.

      I have been doing some work as it relates to Iowa’s use/abuse of administrative laws. They make claim that all 50 states must adhere to the same laws, when in fact they selectively abuse the constitution by claiming certain actions they bring against citizens are a “right” they have, as the levy is against abuse of a priveldge, not a matter of law; all the while individuals are also being prosecuted in a criminal court. FAR from 50 states abuse it’s citizenry this way…

      Too many constitutional issuses to list here right now. Simply put VERY few states adhere to this double prosecution standard. It originated in Louisanna under French/Cajun law…way out in the ozone law. Iowa uses it to generate cash flow at the expense of it’s citizenry…they levy HUGE fines and unequitable sentences as a DOUBLE punishment. Only about 4 states use such draconian means to fill their coffers.

      I may use the Iowa Board of Pharmacies ass backwards legal logic to attack the administrative laws in Iowa.

      Anything to do with controlled substances begins at the state level. Read Gonzales v. Oregon, 546 U.S. 243 (2006), and the appeal court and district court rulings in that case. It lays out the entire scheme of the federal drug law, which does not define accepted medical use. Accepted medical use is defined by the state. The first thing the Iowa Board of Pharmacy tried to tell me is that federal law prevents the state from rescheduling. Iowa rescheduled marijuana in 1979 and again in 1987, proving it knows damn well it is not bound by federal scheduling. They stepped right into the tar baby and got stuck. It was so easy, I didn’t even have to work hard to get them to expose their blatant ignorance of the law.

      Being a life long resident of Iowa I can tell you of the good ole boy rule here. Until the state is challenged it is business as usual to attach exorbinate fines, jail sentences way out of proportion to the offense, deny citizens protection under both the state and federal constituions. As I had previously mentioned their use of “administrative law’ and phoney marijuana “tax stamps” is but one of many…

      This goes in many directions, their “drug tax stamp’ to impose a “civil”/”administrative fine” on top of any criminal charges and/or fines is just one of many. They will impose a “civil” fine just because they say they can >> because you don’t have a permit which the disclaimer on the application form openly admits the tax stamp is worthless. Their intent is VERY clear here,to sell you a worthless piece of paper claiming to exempt you from “civil fines” all the while to bilk money out of people through duel prosecution.

      The Iowa DOT is even worse, you can be innocent in a court of law but guilty in “their” court and be fined, forced to jump through “their” hoops, lose you licence, pay huge insurance fees, with NO LEGAL STANDING. Their hiding behind driving is a priviledge BS. They make extreemely short appeal times (couple days), much like the federal conviscation laws. You are never allowed a court appearance, only a call in hearing with their judge who only works for them. “The fox guarding the hen house”.

      When you PAY for a licence, you PAY for state and federal gas/road use tax,you PAY for a rubber tax on new tires, you PAY for car insurance, you PAY for licence plates, this extends beyond a “priveledge”, it denies you the right to earn a living.

      The state receives $200 million plus a year in FEDERAL road use tax monies. There are no 50 state federal mandates allowing the DOT the “rights” above and beyond the law and the federal constitution; they claim to have the “right” to deprive citizens of their use of federally funded/supported transportation systems, all the while they are violating the federal constitution and grabbing all the federal dollars they can get their hands on to abuse and misrepresent the Federal constitution… Somewhat of a conudrum to the medical marijuana issue.

      Iowa is infamous for their abuse of “civil penalties” to rob the citizens into suppression; the DCI, DOT, DNR… nearly every Iowa state agency abuses the system.. This is their new TEA TAX/CASH COW system…

      ENOUGH IS ENOUGH… EVERY state agency in Iowa is deep in the tar, but way in the RED by incompenency… I am about as far to the right when it comes to love of this country but off the scale to the left when it comes to OUR inalienable rights as OWNERS of this country >>> time to take back what is already ours…

      I have an extremely narrow focus – marijuana. I’m sure that the Board of Pharmacy is not the only administrative agency abusing its power in the state of Iowa, but it’s the only agency I’m dealing with. I’m proving that you can hold them accountable, but it’s no easy thing to do. If you look at the amount of work I’ve put into this, you’re looking at the amount of work it would likely take to challenge any administrative agency in Iowa. If you feel up to the task, go for it. It won’t change unless people do something about it. I’m doing something about it. I can’t do everything. I’m doing what I think is a priority. I hear people talk all the time, but I don’t see many of them doing anything about it. People look at what I’m doing and start telling me all kinds of stuff I could be doing. Sorry, I’m just one person and I can only do so much. I hope my success will encourage others, but its taken me 30 years of legal research to get this far. You won’t just slap a legal argument together in a couple days. It takes a tremendous amount of work.

      True and everyone appreciates your tireless work. Much of the case law and approach has the same merits against adminstrative law abuses in Iowa. I have a major law firm working for me which is handling this and other civil issuses.

      Carl, I applaud your work. I have to admit the first time I read your name I thought “Garrison Keillor and Norwegian bachelor farmers.” :-) It sounds like you have their mythical tenacity.

      What is not so obvious is they (the people opposing us) do this so they can be assuredly called outrageous hypocrites that neither follow the Bible nor God nor our Founding Documents. And they are busy fulfilling all the worst aspects of the King the founding fathers cut their ties with.

      In the Declaration of Independence it clearly states their disgust with these historical and updated parallels

      • endless legal hurdles imposed on them, strictly to wear them out
      • repeated power grabs pushing towards tyranny
      • the creation of a multitude of offices that consume all our resources
      • the military has definitely become superior to civilian authority
      • SWAT teams are practically standing armies, above the law
      • the military and SWAT definitely are protected with mock trials and wrist slaps
      • and on and on…

      Nearly everything the colonists were disgusted with in King George has long been the case in modern times, and only getting worse!

      I agree about the abuses of power, but I’m proving that something can be done about it. I won in court in April, and the Iowa Board of Pharmacy announced two weeks ago that it is going to recommend legalization of marijuana for medical use in Iowa. That’s a couple of victories in a row and I still have my civil case pending against the Board. If I can do all of that, then so can others. I’m proving that peaceful, non-violent resistance still works the way our founding fathers intended it to work when they established the form of government hoping that they had just fought a war that others would not have to fight again. I do have to fight, but my weapons are words not bullets.

I was reminded this morning of one of my heros Dr. Martin Luther King jr. he stood up for people that were being opressed he stood up for people that would be prosecuted for standing up for themselfs he used hes words his knowledge and his love of what was right and fair to change how people treated blacks the same way you are helping change the way people think about pot smokers instead of being opressed for our skin color we have been opressed and for our beliefs.

      The thing is the “agencies” of the State of Iowa still just don’t get it. Marijuana for medical use will soon no longer be a “crime”, it will happen VERY soon. For the state “agencies” to try and do their big last round up just isn’t going to fly.

      The State can honor their obilgations or face belittlement in the eyes of the nation… The choice shouldn’t be that hard…

      The ass backwards mental images of the “Reefer Madness” era funded by the big tobacco companies is dead, so let’s bury it NOW…

      If the “agencies” of the State of Iowa want to have an onslought of law suits against them for abusing persons constitutional and civil rights… they most certainly will be accomidated.

      Now is the time for the state to embrace President Obama’s recent mandate on medical marijuana and realize, their threats/tactics will no longer be sanctioned or tolerated.

      OK so get this 12:30 today on channel 13 the anounced that they are cutting funding for treatment facilities no more will treatments help marijuana users or alchool abusers only meth addicts what dose that leave ??? the only option marijuana users had when busted was prison or treatment now theres no more treatment so now what? straight to prison? or decriminalization ? it seems tho are the only 2 option left with the budget crisses in iowa either we spend even more money on inprisoning marijuana users wich it will cost more then a treatment center or to help this crises by ooohh say selling a pack of joints which will regulat it and tax the freakin heck out of it it may seem extrem but thats all thats left extreems so either the right thing is done or we go further in debt by increasing the war on drugs because i tell you i like MANY people have been following all this pretty close and thoses are the only options that are left so now what ? can Iowa take the right road or will we head down a dead end again?

      Studies are that in Iowa it could yield up to $200,000,000 in new tax revenue. OK add that to not housing prisoners for BS pot charges and trying to “rehab” them and it probably would double.

      It is good to see at least one person keeps up with the posts.

      This significant issue is the bona-fide medical use of marijuana for pain relief and other benifits. The government don’t give a shit about your body or your rights to it. They see the individual as their cash machine. If you can make them money being alive, what good are you?

      This comes back to the bona-fide use as a medicinal treatment, even the DEA’s own judge has testified marijuana is the safest known form of treatment for a wide range of medical problems based on it’s THC, CBD, CBN and other components.

      There has never been one recorded over dose in recorded history due to marijuana, while the big drug companies kill a couple hundred thousand a year; both with prescription and over the counter “drugs”.

      The MLD for marijuana you would have to consume SIX (6) pounds orally or over 100 grams of pure THC. NEVER happened and NEVER will.

      It’s all about money, people just pay the tax and make the boogie man go away…

      The budget cuts are done by others than the legislature, they discuss and rubber stamp their desicions based on the recommendations of others.

      The Board of Regents sets their own cuts as does every state agency once they are given notification of their budget cuts for the upcoming fiscal period.

      When the state of Iowa would stand to have a new source of revenue in the $200,000,000 range who are trying to shit!!

      Address it now and have $200,000,000 plus to add to the black in the states budget.. That would be too easy and the “good ole boys” wouldn’t get their antiquated way..

      Not to mention they would probably save a like amount from their BS pot prosecutions, prisoner housings and “rehab”.

      This state is becoming a joke… and they wonder why when students grad they leave!!!

      Kind of reminds me of 1937 when the American Medical Association opposed the Marihuana Tax Act. Congress passed it anyway. And, again in 1972 when the Commission on Marihuana recommended decriminalization for person use and distribution without profit. Congress ignored the findings of the Commission. And, again in 1988 when the DEA’s Chief Administrative Law Judge said marijuana was extremely safe for use under medical supervision and the DEA Administrator rejected those findings. So, here we are in Iowa, in 2009 about ready to get a favorable ruling from the Iowa Board of Pharmacy and the Iowa Legislature says it will not consider legalizing marijuana for medical use in 2010. Deja Vu, isn’t it?

      The FEDERAL CONSTITUTION does not give the state or federal government the right to INVENT LAWS, when there is no empirical data to support that marijuana harms society, or is a “gateway drug”.       I have been studying state, federal, and international drug law for a long time and one of the things I’ve learned is that coca leaves and opium poppy are both in Schedule II even though they have no accepted medical use in treatment in the United States. The DEA claims they were put there because useful pharmaceutical drugs are made from them. When I suggested that Marinol could be made from marijuana, the DEA responded by saying that Marinol is made from synthetic delta-9-THC so it does not come from the marijuana plant. If you look at the scientific literature, it says delta-9-THC is the principle psychoactive ingredient in marijuana. It even says that in the Federal Register when Marinol was scheduled by the DEA (to Schedule II in 1986 and to Schedule III in 1999). And, of course, the HHS now has a patent on extracted cannabinoids since 2003. So, the case for removing marijuana from federal Schedule I has been strong since at least 2003, if not 1986. This AMA recommendation should be the final piece, but I’m not sure the DEA will just do this voluntarily. It would be really great if some brave state filed a notice with the DEA telling the DEA that marijuana now has accepted medical use in treatment in the United States, and that it no longer meets the requirements for inclusion in Schedule I. The federal law says “in the United States” and the last time I counted there were 50 of them. One of those states should step forward and assist the DEA in doing the right thing.

      There is NO plausable reason not to legalize it and create a new source of revenue and quit making people suffer and live in fear!!

      my grandpa worked for the government for 40years as a mathmatichin he lived in every state but florida and washington he was a briliant man a genius in math he would never tell anybody exactly what he was doing for the government but he told us all not to trust the government they were more corupt then any crook he and my grandma took in over 100 foster kids and had 7 kids of thier own ALL of us were toght this from a man that gave his life to the government i think we all wanted to make it better we need to be able to trust our government we need to be able to serve or work for the government and trust that we are in the company of good people and a good and just system the system is corupt the people in the system are corupt were finaly getting people in offices that grew up not trusting the government and wanting to make it better my hope is that i will not have to give my grand kids the same speach we all got. peace

      When there are reams of files that support medical marijuana’s use, it has only been illegal for 70 years..
      They sure as hell could have done as much research as was ever needed there are NO KNOWN OVERDOSES in 7000 years, when there are people (Iowa Board of Pharmacy), who made opening statements before any hearings were ever heard that they were against it, there is a DEA head who simply doesn’t honor the facts,but the DEA judge does recommend rescheduling or legalization.

      When the local Cedar Rapids TV station puts a “professional” who publically states medical marijuana is a “GATEWAY DRUG” >>> she needs to get her shit straight and substanciate her lies to the media with hard cold facts >>> not her ASSUMPTIONS.

      BIG MAC’s are a gateway food!!! GET REAL, if you have tendencies to abuse you will abuse something >> food, sex, alcohol, you name it >>> GATEWAY what a joke…
